Legal Construction of Medical Data Privacy Rights Protection Based on Maqasid al-Shariah Principles

The digital transformation of healthcare has expanded medical data processing through information exchange, secondary data use, and artificial intelligence, while increasing risks to patients' privacy, dignity, and informational control. This study aimed to analyze the challenges of protecting medical data privacy rights and formulate a legal construction grounded in the principles of maqasid al-Shariah. A descriptive qualitative design with a systematic literature review approach was employed to examine 80 conceptually rich qualitative articles published between 2018 and 2025 and selected through a systematic review reporting protocol. The data were analyzed descriptively and comparatively through conceptual coding and thematic synthesis. The findings identified five domains of protection: medical data dignity protection, purpose-bound processing, harm-based access limitation, accountable health data stewardship, and maslahah-proportional data utilization. These interconnected domains formed a maqasid-based medical data privacy protection construction that conceptualized privacy protection as a continuous evaluation throughout the data processing lifecycle. The study developed the Maqasid-Based Medical Data Privacy Protection Construction as a normative balancing architecture that shifted consent-based protection toward continuous maqasid-oriented privacy governance and provided evaluative parameters for digital health data governance.
