Constitutional Normative Vacuum in Regional Head Replacement Under Article 173 of Indonesia's Regional Government Law
Abstract
Indonesia’s regional government system faces a normative vacuum regarding the replacement of regional heads in certain circumstances that are not comprehensively regulated by existing legislation. Article 173 of Law Number 23 of 2014 on Regional Government is considered inadequate in providing legal certainty, particularly when a regional head is dismissed, dies, or becomes permanently incapacitated before the end of the term of office, creating potential constitutional uncertainty in regional governance. This study analyzes the normative vacuum in Article 173 and evaluates its constitutionality from the perspective of citizens’ constitutional rights to legal certainty and good governance. The research uses a normative juridical method with statutory, conceptual, and case approaches, analyzed descriptively and qualitatively. The findings show that Article 173 contains a constitutional-level normative vacuum because it does not comprehensively regulate procedures, timeframes, and accountability mechanisms for replacing regional heads in various vacancy situations. This deficiency potentially violates the principles of legal certainty and the democratic rule of law guaranteed by the 1945 Constitution of the Republic of Indonesia. The study concludes that a comprehensive reformulation of the provisions on regional head replacement is necessary to fill the legal vacuum and ensure the continuity of constitutionally sound regional government administration.
